Section 53
Provisions relating to Trade Unions of Civil Servants

(1) Civil servants may form trade unions subject to this Act (2) When forming a trade union in accordance with sub-section (1), the following provisions shall be followed:-
(a) Apart from gazetted employees who are required to work as head of office, gazetted employees of the third category or below may form and take membership in trade unions of national level civil servants for the benefit of their professional rights.
(b) The registration of trade unions of civil servants will be in the Department of Labor and Employment Promotion.
(3) The formation of the official trade union of civil servants shall be as follows:-
(a) An official trade union of civil servants may be formed by the members of the trade union of civil servants formed in accordance with sub-section (1) consisting of officials chosen by them.
(b) The official trade union of civil servants will be allowed to present their professional demands to the relevant bodies at the district level, departmental level and national level and engage in social dialogue and collective bargaining. In the event that an official trade union of civil servants has not been formed, the trade union associations of civil servants formed according to sub-section (1) shall have the right to conduct collective bargaining by mutual agreement.
(c) Other arrangements related to the official trade union of civil servants shall be as prescribed.
(4) The work, duties and rights of the trade union of civil servants will be as follows:-
(a) It shall be the duty of the trade unions of civil servants formed according to sub-section (1) and (3) to provide constructive suggestions and support to the Government of Nepal to make the civil service effective and dynamic by protecting and promoting the rights and interests of the employees.
(b) Trade unions of civil servants can conduct creative and creative activities such as gatherings, training, seminars, etc.
(c) to form a federation of trade unions of civil servants, to become members thereof, to become members of international associations or federations and to represent them on behalf of their organizations;Shame on you.
(5) While making laws related to civil service, the Government of Nepal may take the advice and suggestions of the official trade union of civil servants.
(6) If there is a request from national level trade unions and officials of official trade unions formed according to sub-sections (1) and (3) to be transferred to a place suitable for their area of ​​work, the authority should make arrangements for the transfer in a suitable manner.
(7) Arrangements for the central officers and members of the national level trade unions formed as per sub-section (1) and (3) to participate in domestic and foreign seminars, conferences, conventions, organization-related activities, etc. without incurring any financial liability to the Government of Nepal for a maximum of thirty days in a year. (8) The registration of trade union of civil servants, related conditions, procedures and other provisions shall be as prescribed.
